Welcome to SipurMe! The terms "we", "us", and "our" refer to SipurMe. SipurMe operates this store and website (sipurme.com), including all related information, content, features, tools, digital products, and services in order to provide you, the customer, with a bespoke digital storytelling experience (the "Services"). SipurMe is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

 

Please read these Terms of Service carefully, as they include important information about your legal rights and cover critical areas such as parental consent warranties, artificial intelligence (AI) processing, warranty disclaimers, and limitations of liability.

 

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree to these Terms of Service, our Privacy Policy, or our Refund Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence (at least 18 years old in the United States), and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including placing custom orders for our digital storybooks, you may be asked to provide certain information, such as your email address, billing information, and specific content for personalization (including child photographs, names, and dedication messages). You represent and warrant that all the information you provide is correct, current, and complete and that you have all necessary legal rights to provide this information.

 

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

 

SECTION 2 - OUR SERVICES & CUSTOM DIGITAL PRODUCTS

SipurMe creates custom, personalized digital children's storybooks and printable coloring pages delivered in PDF format. Each product is uniquely crafted using the photographs, name, age, gender, and dedication message provided by the Customer.

We have made every effort to provide an accurate representation of our products and artwork in our online store. However, please note that colors or product appearance may differ from how they appear on your screen due to your specific device settings, display color calibration, and printer configurations.

We do not warrant that the final artistic style, likeness, or quality of any custom product purchased by you will meet your exact internal expectations, as digital illustration involves artistic interpretation. All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product or package at any time and may limit the quantities of custom commissions we accept on a weekly basis.

SECTION 3 - PARENTAL CONSENT & IMAGE RIGHTS WARRANTY

Because our Services involve custom illustrations based on photographs of children, strict image rights apply. By uploading any photograph to SipurMe, you legally warrant, represent, and covenant that:

  1. Parental Authority: You are the legal parent or guardian of the child depicted in the uploaded photograph(s), OR you have obtained explicit, documented legal permission from the child's legal parent or guardian to submit such images for the purpose of creating custom digital artwork.

  2. Right to Authorize: You have the full legal right and authority to authorize the use of the uploaded images by SipurMe and our third-party design tools.

  3. No Infringement: The uploaded images do not infringe upon any third-party copyright, privacy right, publicity right, or intellectual property right.

  4. Indemnification for Unauthorized Submission: You agree to fully indemnify, defend, and hold harmless SipurMe, its owners, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) any unauthorized submission of a child's image; (b) any custody, parental rights, or privacy disputes related to the uploaded photos; or (c) any misrepresentation of your legal authority to submit such images.

SECTION 4 - CONSENT TO AI & THIRD-PARTY PROCESSING

By placing an order with SipurMe, you explicitly acknowledge, understand, and agree to our digital illustration workflow:

  1. AI & Digital Rendering Tools: The photographs you upload will be processed by secure third-party artificial intelligence (AI) image processing tools and digital illustration software solely for the purpose of creating your custom personalized storybook character and artwork.

  2. Integral Service: This digital and AI processing is a necessary and integral part of our service delivery.

  3. Data Security & Deletion: SipurMe partners strictly with third-party tools that maintain industry-standard data security. Uploaded images are used exclusively for order fulfillment and are permanently deleted from our active servers and third-party processing workflows within 30 days of order completion, in strict alignment with our Privacy Policy and U.S. Children's Online Privacy Protection Act (COPPA) standards.

SECTION 5 - INTELLECTUAL PROPERTY & LICENSE

  1. SipurMe's Ownership: SipurMe (and its affiliates or licensors) retains full copyright, ownership, and intellectual property rights to the final digital artwork, story narratives, illustrations, design layouts, and overall creative work contained in the delivered PDF storybooks and coloring pages.

  2. Customer License: Upon full payment of your order, SipurMe grants you (the Customer) a personal, non-commercial, non-exclusive, non-transferable, worldwide license to download, view, and print the delivered PDF files for personal family use and display only.

  3. Prohibited Uses: You must not reproduce, distribute, resell, sublicense, publicly display for profit, or use the artwork or storybook files for any commercial purpose (including selling printed copies or uploading artwork to print-on-demand marketplaces) without prior explicit written consent from SipurMe.

  4. Trademarks: SipurMe's name, logo, design marks, and slogans are trademarks of SipurMe. You must not use such trademarks without our prior written permission. Shopify's name and logos are trademarks of Shopify Inc.

SECTION 6 - ORDERS & NO REFUND POLICY

When you place an order, you are making an offer to purchase. SipurMe reserves the right to accept or decline your order for any reason at its discretion. We must receive and process your full payment before your order is accepted and production begins.

NO REFUND POLICY FOR CUSTOM GOODS: Because every SipurMe product is a bespoke, personalized digital creation where manual and computational artistic work begins immediately upon order placement, all sales are final. Once an order is submitted and accepted, no refunds, cancellations, or exchanges can be offered. Please review your inputted spelling (child's name), selected theme, and uploaded photos carefully before submitting your checkout.

In the rare event that we make a typographical error or technical mistake on our end that deviates from the text/photos you submitted, we will gladly revise and resend the corrected digital file at no additional charge.

SECTION 7 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include applicable state or local sales taxes, which will be calculated and added at checkout where legally required by U.S. law.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our store. You represent and warrant that: (i) the credit card or payment information you provide is true, correct, and complete; (ii) you are duly authorized to use such payment method; and (iii) you will pay all charges incurred by you at the posted prices, including all applicable taxes.

SECTION 8 - DIGITAL DELIVERY & NO PHYSICAL SHIPPING

  1. 100% Digital Download: SipurMe sells exclusively digital products. No physical book, printed item, package, or tangible goods will be shipped through the mail to your physical address.

  2. Delivery Timeline: Upon completion of your custom order, you will receive a high-resolution, print-ready PDF file delivered directly to the email address provided at checkout. Our standard delivery turnaround is 3 to 5 business days from order placement (or within 24 hours for Express Delivery orders).

  3. Delivery Responsibility: It is your responsibility to ensure your email address is entered correctly at checkout and to check your spam/junk folders. If you do not receive your file within the specified timeframe, please contact us at support@sipurme.com.

SECTION 9 - OPTIONAL TOOLS & THIRD-PARTY LINKS

You may be provided with access to customer tools offered by third parties as part of the Services (such as image upload widgets or digital download portals), which we neither monitor nor control. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or endorsements. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

The Services may also contain hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of third-party websites and are not liable for any harm or damages related to your access to or transactions with any third-party website.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

SipurMe is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with SipurMe. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SipurMe, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SipurMe.

SECTION 11 - PRIVACY POLICY & DATA PROTECTION

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed on our website. Because the Services are hosted by Shopify, Shopify also collects and processes personal information about your access to and use of the Services.

We comply strictly with U.S. privacy standards, including the Children's Online Privacy Protection Act (COPPA). We do not collect data directly from minors; all child-related data is submitted by consenting adults solely to fulfill custom orders. SECTION 12 - FEEDBACK

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, customer reviews, product photos, or proposals (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any commercial or marketing purpose (excluding the private reference photos of your child, which are strictly governed by our Privacy Policy).

You represent and warrant that your Feedback does not violate any third-party rights and does not contain libelous, abusive, or malicious content. We take no responsibility and assume no liability for any Feedback posted by you or any third party.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

 

SECTION 14 - PROHIBITED USES

You access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful purpose; (b) to violate any international, federal, state, or local laws or regulations; (c) to infringe upon our intellectual property rights or those of others; (d) to submit photographs of minors without legal parental authority or consent; (e) to harass, abuse, defame, slander, or harm others; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to scrape, data mine, or use automated robots/AI agents to extract data from the Services; or (i) to resell, redistribute, or commercially exploit our digital storybook files without authorization.

We reserve the right to terminate your use of the Services immediately for violating any prohibited uses.

SECTION 15 - AGENTS & AUTOMATED ACCESS

No software agent, automated bot, or AI agent may access, use, or interact with our Services unless it identifies itself in its HTTP/HTTPS request user agent string and strictly complies with standard robot exclusion protocols. We reserve the right to block, limit, or terminate any automated access that restricts or harms the functionality of SipurMe or Shopify.

SECTION 16 - DISCLAIMER OF WARRANTIES

THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR DO WE GUARANTEE THAT ARTISTIC INTERPRETATIONS IN CUSTOM ILLUSTRATIONS WILL EXACTLY MIRROR REAL-LIFE PHOTOGRAPHS.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE U.S. LAW, IN NO CASE SHALL SipurMe, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS, OR THOSE OF SHOPIFY, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR ANY SIMILAR DAMAGES, ARISING FROM YOUR USE OF THE SERVICES OR ANY DIGITAL PRODUCTS PROCURED USING THE SERVICES.

IN NO EVENT SHALL SipurMe'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE EXACT AMOUNT PAID BY YOU TO SipurMe FOR THE SPECIFIC CUSTOM ORDER IN QUESTION.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SipurMe, Shopify, and our affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from or arising out of: (1) your breach of these Terms of Service; (2) your violation of any U.S. or international law or the rights of a third party; or (3) your unauthorized submission of a third-party photograph or a minor's photograph without documented parental consent.

SECTION 19 - SEVERABILITY & TERMINATION

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable under applicable U.S. law, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.

We may terminate this agreement or your access to the Services at any time without notice if you fail to comply with these Terms. All provisions which by their nature should survive termination (including Ownership, Indemnification, Disclaimers, and Limitations of Liability) shall survive.

SECTION 20 - GOVERNING LAW & DISPUTE RESOLUTION

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.
